The hypothesis is that the law, which sought to include females in the order of legal discourse, (re-) affirms the marginalization of Brazilian women. The study is guided by the following theoretical contributions: the discursive perspective of the French approach, Foucault's concepts of Archaeology and Genealogy, and Derrida's deconstruction theory. The results lead to the conclusion that this particular law is inevitably affected by subjectivity having meaning effects that maintain the power of submission, beliefs, and values that intervene in the discursive practices, the cultural dimension, and the historical and collective experience of the subjects.
